Article 1: Scope
These general terms and conditions of sale (hereinafter referred to as the “Terms”) govern the contractual relationship between ABCDO (hereinafter referred to as the “Seller”) and the customer (hereinafter referred to as the “Customer”), for the sale of digital products via the Seller’s website (hereinafter referred to as the “Site”).
Article 2: Acceptance of Terms
Any order placed on the Site implies the Customer’s unconditional acceptance of these Terms. The Customer declares that they have read and understood these Terms and accept them without reservation. The Seller reserves the right to modify these Terms at any time. The modified Terms will apply to any order placed after the date of their modification.
Article 3: Products
The products offered for sale on the Site are digital products, including:
- Ready-to-use Elementor templates: Pre-designed web page templates for the Elementor page builder. These templates may include layouts, widgets, styles, and pre-configured settings.
- Photoshop (PSD) images: Photoshop (.psd) files containing images and ready-to-use graphic elements. These images can be modified and adapted to the Customer’s needs.
- Adobe XD files: Adobe XD (.xd) files containing user interfaces and design prototypes. These files can be modified and customized by the Customer.
Each product is accompanied by a detailed description indicating its main features, compatibility and technical requirements. The Seller undertakes to provide the Customer with products of quality in accordance with the descriptions appearing on the Site.
Article 4: Sales and Exploitation Rights
- Sale: The Seller grants the Customer a non-exclusive and non-transferable license to use the purchased products for their own personal and professional needs. The Customer is authorized to use the products to create personal or commercial projects.
- Exploitation: The Customer is authorized to modify, adapt and integrate the products into their own projects. They are also authorized to distribute the products in the form of final files integrated into their own projects, provided that they do not distribute them in the form of editable source files.
Prohibitions:
- The Customer is not authorized to resell, sublicense or distribute the products in the form of editable source files.
- The Customer is not authorized to use the products for illegal purposes or contrary to public order.
- The Customer is not authorized to remove or modify the copyright and intellectual property notices appearing on the products.
Article 5: Order
Orders are placed directly on the Site. The Customer selects the products they wish to purchase and adds them to their cart. Once the cart has been validated, the Customer creates an account or logs into their existing account. The Customer then enters their delivery and payment information. Payment is made by credit card via a secure payment system.
Article 6: Payment
Payment for products is made exclusively by credit card. The accepted cards are: Visa, MasterCard, and American Express. Payment is secured by a payment system approved by the Central Bank of Tunisia.
Article 7: Delivery
Digital products are delivered by download. After confirmation of payment, the Customer receives a download link by email. The Customer can also download the products from their account on the Site.
Article 8: Right of Withdrawal
In accordance with applicable law, the Customer does not have a right of withdrawal for downloaded digital products.
Article 9: Intellectual Property
The products sold remain the exclusive intellectual property of the Seller. The Customer acquires a license to use the products but does not become the owner of the intellectual property rights to the products.
Article 10: Data Protection
The Seller undertakes to protect the Customer’s personal data in accordance with applicable regulations. The information collected is used only for the purpose of processing orders and improving the Seller’s services. The Customer can access and modify their personal information at any time by contacting the Seller’s customer service.
Article 11: Liability
The Seller cannot be held liable for any damages resulting from the use of the products sold. The Customer is solely responsible for the use of the products and for any damage that may result from them.
Article 12: Disputes
In the event of a dispute, the parties undertake to seek an amicable solution. Failing this, the competent court will be that of the place of establishment of the company ABCDO.
